Summary 

This Trade Gate Policy explains our criteria in how we detail information of your item to be placed for sale in our On-Line Store. It may be for your business or for you personally, so long as you are a member with us. We take very seriously such details so as a member you are protected by the appropriate Australian laws governed by Australian Consumer Law. They shall also be covered by the relevant return policy and other criteria as detailed herein.

To participate in the On-line Store program, you must hold a valid membership with Trade Gate, and therefore agree to trade within the parameters adhering to the Australian applicable laws that are set out appropriately below. We ask that you read them carefully and understand them. All our contact details are given on this website www.tradegate.au 

The On-Line Store is owned by Eagle Wealth Strategies, ABN 33 048 104 610 of which the registered business name of Trade Gate belongs to Eagle Wealth Strategies. All members or persons who use this website agree or are in agreement of the trading program that have access to and who use this website or of any transacting/transactions between members and Trade Gate are therefore bound by this Policy.

Eagle Wealth Strategies on behalf of Trade Gate and any communications herein maintains that we negate liability for any content or information you have chosen to share with us, as we will assume you have done so in good faith. We admit to no legal liability that you submit or offer interaction with other business owners, as you do so as a trading entity of Trade Gate, with the details you solely provide. As such we offer no representations or warranties, express or implied, and that we are not liable whatsoever. We are severable from any actions against us concerning personal or business information submitted to us, whether if it means offered to Eagle Wealth Strategies or Trade Gate as we are not liable whatsoever for any potential outcome, but we adhere to the Privacy Act of 1988 containing sensitive information. We make every attempt to provide as accurately as possible details displayed herein of a product sold, or of a service submitted on your behalf or of you as a member. Eagle Wealth Strategies nor Trade Gate shall be and are as such not liable for any special or consequential damages that result from a member’s use thereof, or the inability to use properly, the services and products offered on this website, or the performance and the services and products listed by the members facilitating interaction via Trade Gate.

1/1 Submitting an Item to be Listed on our On-Line Store

When wishing to place an item for sale in the On-Line Store, you agree and understand, that to do so the details of the item for sale, must be submitted to your Trade Gate office administering management of your account. Therefore, you agree to the following.

1. (i) The reason for doing things this way, is to uphold integrity and stop any attempt to inappropriately increase the value of the item for sale, which would be in direct conflict with fair pricing under Australian Consumer Law.

(ii) When an item is listed, you may only contact your appropriate manager to express an interest to buy.

(iii) Likewise, you agree that you must consult with your appropriate office to discuss what you wish to have listed for sale.

(iv) You will supply all images of the item and details and benefits accordingly. Trade Gate will upload the item for sale; with the details you supply.

2/1 Personal Information

1. Although your personal details won’t be displayed, and it is obvious who is the seller, you may contact them as a business to business interaction expressing you are the appropriate owner. However, for the transaction to go ahead, you will need to communicate with your appropriate office, who will record all details of the buyer and the seller, and give conformation.

(i) You accept that the reason to do this, is to stop inflationary pressure.

(ii) All parties abide by applicable Australian law.

(iii) Members agree to these imperative conditions, so as to uphold integrity.

(iv) Under the Australian Privacy Law, we take seriously the appropriate Act. We will not disclose any personal information whatsoever. Only if we receive permission from the member seller or buyer, will we then sanction the interaction.

3/1 Returns

1. In accordance with Australian Consumer Law ‘our’ Return Policy adheres to ‘your’ legal right along with ‘our’ legal rights. We understand that mistakes can happen, thus please carefully read the following.

2. The products we sell require appropriate handling. This means that processes to load etc. requires time and effort. This is why we do not allow returns when a customer just wishes to return ‘product/products’ through sentiment alone. However, under exceptional circumstances ‘we’ hold the exclusive right to override this Condition.

(i) Providing ‘you’ have the written authority by an authorised Trade Gate authorised employee. i.e. an Account Manager.

(ii) This must be within a seven day period. No questions asked.

a. Not applicable for perishable goods.

(iii) After You have informed us within seven days of receiving the goods/item. Then that item/items may be sent back for a total refund. But you are responsible for the following.

a. Return costs

(iv) Outside of a fourteen-day period, you cover the costs also for the return, but Trade Gate and the Seller shall determine if anything is untoward. i.e.

(v) a. Misuse of the product

b. Trade Gate is not responsible for legal costs, as such is indemnified totally.

(vi) The product is not opened or soiled.

(vii) The product’s packaging is not damaged.

(viii) ‘You’ accept our/ handling fee of $T30 + GST or 15% of the purchase price or whichever is greater, plus the appropriate delivery charges. 

(ix) Item is not the same as described or as in the image supplied on-line.

a. Then if upheld a refund shall be given by the Seller for up to a twenty-eight-day period. 

Note: No cash refund is accepted. The complete purchase is always transacted in trade dollars. However, we believe that our members will try to act in a reasonable manner in the event of an anomaly, and expect all involved with amicably sort things out, so as to avoid the least possible disruption. 

4/1 Who can be Actioned to Submit Items for Sale

1. In order to sell, you must have the following.

(i) An owner or a manager.

(ii) Be at least eighteen years of age or older.

(iii) Be accepted by us.

(iv) Not be declared bankrupt.

(v) Must be contactable via phone and have a valid appropriate business email address. Must be contactable.

(vi) Demonstrated by the business owner, that they have authority.

5/1 Copyright and Item Details

1. The entire contents included in the On-Line Store, including but not limited to text, includes images also, are thus subject to Australian copyright law. Such images remain the property of Trade Gate and the member, or until the item is sold, or discontinued. After which the conditions applied by Australin consumer law shall apply.

(i) Under Australian rule, conditions apply. You may not lie. Actions may apply, via the appropriate bodies for misuse accordingly.

(ii) The Seller assumes all responsibility to the item details being listed. Included their accuracy. Trade Gate accepts no liability whatsoever.

(iii) The Purchaser may not ask for a cash component in the transaction.

(iv) The Seller may not ask for cash in transporting the item. It is strictly trade only. Nor can a Seller try to ask for punitive costs. It is strictly trade only.

(v) A Seller may not offer misleading information, or use incorrect images or try to disclose inaccurate benefits.

(vi) If a Buyer believes the item described for sale was misleading, they may issue a complaint to Trade Gate. Although we do not accept any consequences whatsoever, we will endeavour to mediate accordingly.

1. You agree that you have given Trade Gate permission to electronically list an item supplied by you to be uploaded, and that you are responsible for seeing the accuracy and continues to be therefore upheld. You further agree that you cannot change or delete any proprietary notices of materials downloaded from the website.

(i) You shall agree that information you supply about a product is always accurate.

(ii) You will not provide misleading information about a product, and admit to liability concerning a description of an image, should that be upheld..

(iii) Trade Gate will not allow price gauging under any circumstances. However, as is the strength of barter trading, it is accepted that no discounting needs to take place.

(iv) All members agree to set appropriate standards and to report anybody trying to do promote wrongful member behaviour.

7/1 Trademarks 

All trademarks, service marks and trade names of Trade Gate or Eagle Wealth Strategies are used on the website are registered trademarks. Likewise, trademarks belonging to a member will have their Australian rules for trademarking upheld.

8/1 Warranty Disclaimer

This website and the materials and products on this site are provided “as is” and without warranties of any kind, whether express or implied by Trade Gate. You therefore agree to apply for a product to be uploaded, and you do so, with your full support of these rules. They are either listed as Terms & Conditions, Privacy Policy or On-Line Store Policy.

1. Via the Australian applicable retail laws, you are solely subject to any warranties, for anything you supply, and Trade Gate is exempt as such for providing such warranties. These warranties belong to you.

(i) To the fullest extent permissible applications via applicable pursuant to law, Trade Gate disclaims all warranties, express or implied, including, but not limited to, any implied warranties of merchantability and their fitness for a particular purpose and non-infringement. This is the responsibility of the appropriate member.

(ii) However, Trade Gate reserves the right to supply and upload products.

(iii) When Trade Gate supplies an item for sale, and it is brand-new and has the manufacturers warranty conditions displayed on the packaging, a buyer may claim the manufacturer’s warranty conditions. It is therefor the right of the Buyer to see fit that this warranty is upheld.

(iv) Trade Gate does not represent or warrant that the functions contained in the website or through the trading program will be uninterrupted or error-free, that the defects will be corrected, or that this website or us or the server that makes the website available are free from wrongful transacting.

(v) We can’t either express this website is free of viruses or other harmful components. You transact at your own discretion.

(vi) Trade Gate does not make any warrantees or representations regarding the use of the materials in this website in reliability or otherwise implied. 

9/1 Limitation of Liability

1 Trade Gate shall not be liable for any special or consequential damages that result from the use of, or the inability to use, the services and products offered on this website, or the performance of its services and products.

10/1 Typographical Errors

1. In the event that a Trade Gate product is mistakenly listed at an incorrect price, Trade Gate reserves the right to refuse or cancel any orders placed for a product listed at the incorrect price. Trade Gate reserves the right to refuse or cancel any such orders whether or not the order has been confirmed and your Trade Gate account or credit card charged for fees accordingly. If your credit card has already been charged for the transaction fees and your order is cancelled, Trade Gate will issue a credit to your credit card account/bank account in the amount of the incorrect charges incurred. 

11/1 Termination

1. These terms and conditions are applicable to you upon you accessing the website and/or completing the registration or shopping process. These terms and conditions, or any part of them, may be terminated by Trade Gate without notice at any time, and for any reason. The provisions relating to Copyrights, Trademark, Disclaimer, Limitation of Liability, Indemnification and Miscellaneous, Return Policy shall survive any termination.

12/1 Notice of Closure 

1. Trade Gate may deliver notice to you by means of e-mail, a general notice on the website, informing other members or by any other reliable methods to the address you have broken these Terms and Conditions, or via telecommunication. You are subsequently tied to all appropriate conditions to sell or buy as you remain a member.

(i) Your use of this website shall be governed by the laws of whichever state you operate in, or by our Terms & Conditions.

(ii) You agree that any jurisdiction relating to misuse, both inappropriately of consideration by you to be lawful or as we deem not are subsequent to the state’s appropriate laws. However, Trade Gate accepts no liability whatsoever for transactions appropriated, both on this website and via member to member transactions. You therefore agree to trade under our rules of the program.

(iii) This means, as a member you agree to our terms and conditions.

(iv) That a transaction incurs fees displayed accordingly and shall appear in your monthly statement. This applies to items bought and sold in out On-Line Store.

(v) You agree that any claims to the member purchasing a product, shall solely be your responsibility for its reliability. Likewise, a member selling also. Trade Gate shall assume no liability at all.

(vi) Any course of action is subject to the fact that you have agreed to these terms and conditions, especially as well anything you have listed on our On-Line Store.

(vii) Any attempt to try and negate these terms, means you have four months to offer solutions. If such solutions are not forthcoming, you accept that you were trying to negate the trading rules and that subsequently you accept the terms subsequently stated in 1/1 (iv) were an attempt by you to avoid Trade Gate transacting conditions. As such any costs you incur are your sole responsibility.

a. It will be deemed that you are attempting to negate your responsibility as a member. 

b. You agree to cover absolutely all costs for any mitigation.

c. We reserve the right to inform other authorities that you are attempting such behaviour.

d. Trade gate always wishes to achieve satisfactory outcomes, but will protect proper trading bahaviour.

(viii) Trade Gate may align its right to appoint a lawyer to participate in its legal representation and uphold matters accordingly, if you do not agree.

13/1 Harassment

1 Harassment of members shall not be accepted under any circumstance

15/1 Indemnification

1. You agree to indemnify, defend, and hold harmless Trade Gate, its officers, directors, employees, traders, agents, partners, licensors and suppliers (collectively the “Service Providers”) from and against all losses, expenses, damages and costs, including reasonable legal fees, resulting from any violation of these terms and conditions or any activity related to your account, (including negligent or wrongful conduct) by you or any other person accessing your membership with us, or use via this website using your internet account, or any other forms of communication. i.e. your membership with us also.
