Summary
These Terms & Conditions are not a guideline but are strict explanations in reference on how to purchase and sell from within the member base for Trade Gate. They are mandatory.
To participate in the program, you must hold a valid membership, and trade within the parameters as set out herein. You are governed by these Terms & Conditions, of which you agree to them in whole.
The trading program is owned by Eagle Wealth Strategies, ABN 33 048 104 610 of which the registered business name of Trade Gate belongs to Eagle Wealth Strategies. Please read the following Terms and Conditions of how to conduct your business activity of which you have agreed to such rules of conduct in your application for membership with us. Thereafter you agree to upholding the conditions contained within these Terms & Conditions.
All members who use this website agree or are members of the trading program that have access to and of the use of this website or of any transacting/transactions between members are bound by these Terms and Conditions. This website is subject to the following Terms and Conditions and other applicable law for your benefit and for efficient systemisation. They will include also rule 9/1 1. (i) and subsequent detailed information. However, all actions and communication determined between member of Trade Gate, will constitute all conditions and conclusions herein. This is stated to formulate proper guidelines and eliminate improper use.

Eagle Wealth Strategies on behalf of Trade Gate and any communications herein maintains that offers or interaction with other business owners, do so as the trading entity Trade Gate, as such offers no representations or warranties, express or implied, and that we not are liable whatsoever. If an attempt at trading incorrectly, or that information contained on this website may be incomplete, or misconstrued, means we are severable from any actions against us, whether if it means Eagle Wealth Strategies or Trade Gate we are not liable whatsoever. We make every attempt to provide as accurately as possible information displayed herein and on this website. However, if content is judged by accusation and incomplete, we accept no recourse against us, as potentially inaccurate or that we have provided incorrect information from a product or service listed for sale.
Eagle Wealth Strategies nor Trade Gate shall and are not liable for any special or consequential damages that result from a member’s use thereof, or the inability to use properly, the services and products offered on this website, or the performance and the services and products listed by the members facilitating interaction via Trade Gate, notwithstanding membership. 1/1 (iv)
1/1 Fees & Charges
We have in place certain charges that appertain to you transacting within the membership network.
1. (i) For all purchases or sales, there is a fee of 3.2% cash and a 0.7% on the transaction amount.
(ii) There is a monthly charge of $21.75 plus T$3.35 to pay for your account manager.
(iii) There is a one-off fee for membership, the details of which are displayed in the Application Form for Membership and displayed on the website, or via your discussions with a Trade Gate authority. You agree that by signing the Application Form, you are bound.
(iv) There is a 0.6% fee charged should your account be inactive for two consecutive months on the trade balance deficit, which is a cash charge.
2. A membership may be cancelled, by informing us in writing to our PO Box address. Your fees & charges must be up to date and any trade balance deficit settled in full, to be paid out full in cash, in order to close the said account.
3. (i) Under no circumstances can a member ask for cash in a transaction.
4. (ii) To combat inflationary pressures, Trade Gates policies will be upheld.
5. (iii) You agree to sell your services at normal rates.
6. (iv) It is by all parties that discounting isn’t required.
7. (v) Selling prices are to be upheld, without the need to discount.
7 (v) Any member offering cash in a transaction, will be removed from membership.
2/1 Account Manager’s Roll
1. We take very seriously the need to keep trading at a very high level of efficiency. We therefore have in place criteria and measures which will stop any members trying to apply inflationary pressures by raising the cost of goods or services sold.
(i) All transaction must be authorised by the appropriate office looking after your account. This is done by telephoning your account manager to get an authorisation number for the sale or purchase. We will help in these matters.
(ii) Transactions lower than T$20 won’t need authorisation.
(iii) You can fill out transacting slips and post them to your office at the end of a week.
(iv) For business transacting in multiple amounts through the week, i.e. a café, your Account manager will provide criteria of how to keep track.
(v) For transactions greater than T$20 you do need to call for authorisation, though attempts to negate these conditions, will be met by a penalty fee. This will equate to a cash charge of 22% on the cash component trying to be evaded.
(vi) You agree to these conditions as a way to stop inflation.
(vii) Therefore, if a transaction falls under the T$20 limit, you must fill out a carbonless orderbook. Fill in the details of the purchaser, date, price, and purchaser gets the blue copy. The seller keeps the white copy. Either give the white copy to your BDM or post it to our PO Box address.
(viii) For transactions over T20 you must always call our office to get the sale authorised. You understand in these Terms & Conditions that we do so, because we are protecting the members and you agree accordingly.
(ix) Again, members trying to disrupt this import code of ethics will be removed.
3/1 Getting Products Uploaded for Sale on our On-Line Store.
1. To stop any overpricing of goods, all/any listings must be authorised by the appropriate office looking after your account. Whereas there is no need through barter trading to discount a product to encourage the sale, we put such measures in place to stop overpricing taking place. Such measures will keep the trading experience safe for all members, from members trying to exploit over trading and therefore eliminate inflationary actions. Everything must be authorised by head office.
(i) You can ask to have any item for sale uploaded so long as it meets our guidelines. Though understandably for things like, defective goods, stolen items will be rejected. Appropriate consumer law shall apply, as are the tax implications of which the member is fully responsible.
(ii) New goods must have the appropriate warranties explained.
(iii) Second hand items shall describe the condition or any untoward problems, i.e if a vehicle is for sale. A photo must be displayed should such criteria be shown in the listing.
(iv) Eagle Wealth Strategies or Trade Gate, accept no responsibility or are liable for anything that is for sale. Any recourse of action against the seller by the purchaser, concerning improperly described goods, will be between these two entities alone. Though we will try to mediate should any anomalies occur.
4/1 Who can Participate in our Services
1. In order to be a member, you must have the following.
(i) A valid ABN.
(ii) Be at least eighteen years of age or older.
(iii) Be Accepted by us.
(iv) Not be declared bankrupt.
(v) Must be contactable via phone and have a valid email address.

1. When using our newsletter, you may receive updates and other potential monthly information, that we believe will help your membership experience. You may unsubscribe at anytime.
6/1 Copyright
1. The entire content included in this website, including but not limited to text, includes images also, thus subject to Australian copyright law. Such images remain the property of Trade Gate, or until the item is sold. After which the conditions applied by Australin consumer law shall apply.
(i) Under Australian rule, conditions apply. You may not lie.
(ii) The Seller assumes all responsibility to the item details being listed.
(iii) The Purchaser may not ask for a cash component in the transaction
(iv) The Seller may not ask for cash in transporting the item. It is strictly trade.

1. You agree that you have given Trade Gate permission to electronically list an item supplied by you to be uploaded, and that you are responsible for seeing the accuracy is therefore upheld. You further agree that you cannot change or delete any proprietary notices of materials downloaded from the website.
(i) You shall agree that information you supply about a product is accurate.
(ii) You will not provide misleading information about a product.

All trademarks, service marks and trade names of Trade Gate or Eagle Wealth Strategies are used in the website are registered trademarks. Likewise, trademarks belonging to a member will have their Australian rules for trademarking upheld.
9/1 Warranty Disclaimer
This website and the materials and products on this site are provided “as is” and without warranties of any kind, whether express or implied by Trade Gate. You therefore agree to apply for a product to be uploaded, you do so, with your full support of these terms and conditions.
1. Via the Australian applicable retail laws, you are solely subject to any warranties.
(i) The fullest extent permissible applications to applicable pursuant to law, Trade Gate disclaims all warranties, express or implied, including, but not limited to, any implied warranties of merchantability and their fitness for a particular purpose and non-infringement.
(ii) Trade Gate does not represent or warrant that the functions contained in the website or through the trading program will be uninterrupted or error-free, that the defects will be corrected, or that this website or us or the server that makes the website available are free from wrongful transacting.
(iii) We can’t either express this website is free of viruses or other harmful components. You transact at your own discretion.
(iv) Trade Gate does not make any warrantees or representations regarding the use of the materials in this website in reliability or otherwise.
10/1 Limitation of Liability
1 Trade Gate shall not be liable for any special or consequential damages that result from the use of, or the inability to use, the services and products offered on this website, or the performance of the its services and products.
11/1 Typographical Errors
1. In the event that a Trade Gate product is mistakenly listed at an incorrect price, Trade Gate reserves the right to refuse or cancel any orders placed for product listed at the incorrect price. Trade Gate reserves the right to refuse or cancel any such orders whether or not the order has been confirmed and your Trade Gate account or credit card charged. If your credit card has already been charged for the transaction fees and your order is cancelled, Trade Gate will issue a credit to your credit card account/bank account in the amount of the incorrect charges incurred.
12/1 Termination
1. These terms and conditions are applicable to you upon you accessing the website and/or completing the registration or shopping process. These terms and conditions, or any part of them, may be terminated by Trade Gate without notice at any time, and for any reason. The provisions relating to Copyrights, Trademark, Disclaimer, Limitation of Liability, Indemnification and Miscellaneous, shall survive any termination.
13/1 Notice
1. Trade Gate may deliver notice to you by means of e-mail, a general notice on the website, informing other members or by any other reliable methods to the address you have brokered these Terms and Conditions. You are subsequently tied to them.
(i) Your use of this website shall be governed by the laws of whichever state you operate in.
(ii) You agree that any jurisdiction relating to misuse, both inappropriately of consideration by you to be lawful or as we deem not are subsequent to the state’s appropriate laws. However, Trade Gate accepts no liability whatsoever for transactions appropriated, both on this website and via member to member transactions.
(iii) This means, as a member you agree to our terms and conditions.
(iv) That a transaction incurs fees displayed accordingly and shall appear in your monthly statement.
(v) You agree that any claims to the member purchasing a product, shall solely be your responsibility for its reliability. Likewise, a member selling also.
(vi) Any course of action is subject to the fact that you have agreed to these terms and condition.
(vii) Any attempt to try and negate these terms, means you have four months to offer solutions. If such solutions are not forthcoming, you accept that you were trying to negate the trading rules and that subsequently you accept the terms subsequently stated in 1/1 (iv) were an attempt by you to avoid Trade Gate transacting conditions.
(viii) Trade Gate may align its right to appoint a lawyer to participate in its legal representation and uphold matters accordingly, if you do not agree.
14/1 Harassment
1 Harassment of members shall not be accepted under any circumstance.
15/1 Indemnification
1. You agree to indemnify, defend, and hold harmless Trade Gate, its officers, directors, employees, agents, licensors and suppliers (collectively the “Service Providers”) from and against all losses, expenses, damages and costs, including reasonable legal fees, resulting from any violation of these Terms and Conditions or any activity related to your account, (including negligent or wrongful conduct) by you or any other person accessing you membership with us, or this website site using your internet account, or any other forms of communication.
